After a special court refused to take cognizance of the prosecution complaint (akin to a chargesheet) filed by the Enforcement Directorate against Rahul Gandhi and others in the National Herald case, the Central agency is likely to file a fresh one in a few months. Sources said the agency will file a fresh prosecution complaint in the case after Delhi Police, which has also registered a case in the matter, files a chargesheet. Apart from this, the agency also plans to challenge the special court order in the High Court. “The special PMLA court has not made any observation on the merits of the case but raised a technical issue that the ED case is based on a private complaint [by former BJP MP Subramanian Swamy] and not a predicate offence by another agency. It has also said we can add to the probe thatDelhiPolice is conducting. Once Delhi Police files a chargesheet, we will file a fresh prosecution complaint incorporating the findings of their probe,” a senior ED officer said.
