Gauhati High Court Suspends Possession Order Over 211 Bighas of Land in Assam

A possession order involving more than 211 bighas of land in Assam’s Golaghat has been put on hold by the Gauhati High Court . The court has directed the state government to first dispose of an appeal filed by Mouchak Agro LLP against the requisition of the land. Justice Manish Choudhury passed the order on August 20, 2026, in a case related to property at Rajabali Bagan in the Morangi Revenue Circle of Golaghat district . The land in question measures 211 bighas, 1 katha and 19 lessas. The land was requisitioned on May 6, 2026, when the Golaghat District Commissioner exercised powers granted by the state government under Section 3(1) of the Assam Land [Requisition and Acquisition] Act, 1964. The acquisition was intended to make the land available for an Industrial Estate of Numaligarh Refinery Limited (NRL). Mouchak Agro LLP filed an appeal with the state government on May 29 under Section 3(3), challenging the requisition. Before the appeal could be decided, an order issued on July 28 under Section 4(1) asked the company to surrender or hand over the land within ten days. The state government told the High Court that the appeal was still pending. The court said a person affected by a requisition has a statutory right to challenge the order under Section 3(3). That right, it observed, cannot be undermined while the appeal remains undecided. The High Court therefore suspended the July 28 direction for possession until the state government decides Mouchak Agro LLP’s appeal.
